At this time, I encourage you to bring your concerns to Kamal Gogna by email at [email protected] and ask for a final response. You can mention that you have been to our office and that we have sent you to Toronto Building for a final response. Once you receive a response and remain unsatisfied, please forward the response you received we can review it for administrative unfairness issues. If you do not hear from Toronto Building within 2 weeks feel free to contact our office and with your consent, we can reach out to Toronto Building to facilitate communication.

Monica,
Thank you for following up.
We did, or attempted to, contact everyone that you suggested, as well as many other related officials identified over the course of our inquiries (details included).
What we’ve received is essentially opinions, obfuscation, legal jargon, and dismissive rhetoric over the last 20 months. Toronto Buildings is unable, or unwilling, to answer the simple question: “Does what is built at 13 Collahie St. conform to the bylaw variances as set forth by the COA, and thereby the approved building permit?”
We’ve provided irrefutable evidence to Toronto Buildings including, but not limited to:
- multiple legal surveys,
- the Committee of Adjustment’s decision,
- numerous photos and dimensioned diagrams,
- measurements confirming the structure’s width of 15’ 2-1/2” on a lot that measures only 14’ 3” wide,
- and observations readily apparent from their own site visits
We would like acknowledgement, in writing, stating that 13 Collahie does not comply with the approved bylaw variances and building permit. We also expect that Toronto Buildings will uphold their role to enforce bylaws and building permits, which they have yet to do.
We believe the Ombudsman should be urgently involved, not merely for our sake, but to ensure that policies are in place to avoid issues like this. It is not unreasonable to conclude that if Toronto Buildings inspections processes were adequate and properly conducted any point throughout a construction project, we, and others, would not find themselves in these situations.
Since they are clearly failing in those responsibilities, there needs to be effective mechanisms in place to help/support constituents who have had their property negatively impacted (“the victims”) find resolve to these issues.
